Our Website addresses adults. However, it is possible that customers under the age of 18 call up the Website or purchase products through it. Our rule is that in cases where we know that a customer is under 16 years of age, we will not use their Personal Data for marketing purposes unless we have the written consent of their parents.
- Are Cookies being used?
When you visit our Website, we also process your Personal Data by using cookies and similar technologies such as pixels (collectively, unless stated otherwise, "Cookies").
5.1. What are Cookies?
Cookies are small text files that are stored in the memories of your end devices such as PCs, smartphones or tablet computers ("End Device") when you visit websites. Cookies allow a website to recognize a visitor's End Device during a repeated visit. In this way, Cookies help us to ensure that the Site functions properly and to understand how you use the Site in order to improve our Site and your user experience and tailor the Site to your interests.
5.2. Which Cookies are used and how can you manage these Cookies?
In the cookie management tool you will find an overview of the Cookies we use. The overview contains the purposes of the Cookies and further information on the respective Cookies.

Also you can object to some Cookies centrally at www.youronlinechoices.com. The cookie in question will then no longer collect data about your future visits to our Website. In addition, a renewed setting of the respective cookie is prevented.
- Integration of social plugins and other tools
6.1. Social plugins of Social Networks
On our Website, we provide you with social plugins from the social networks Facebook and Twitter ("Social Networks"). These are offers from the companies:
- Facebook Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin, D02, Ireland ("Facebook");
- Twitter, Inc., 1355 Market Street, Suite 900, San Francisco, CA 94103, USA ("Twitter");
The plugins can be recognized by the respective logos of the companies. You can use these plugins to directly link, share or otherwise be active on the respective network.
Before you click, for example, on the Facebook "Share" and Twitter "Tweet" button, the data protection-friendly alternative used ("Shariff Button") merely transfers our server address to Facebook and Twitter instead of your IP address and other data. As long as you do not click on the social plugin to share content, you remain invisible to the operators of the respective social network.
- For information on the processing of Personal Data on the GEMELLii Social Media sites, please visit https://www.GEMELLii.com/de/Privacy-Policy

This is the inclusion of posts, videos or other content from Instagram LLC (1601 Willow Road Menlo Park, CA 94025, USA; "Instagram") on our Website. However, Facebook is responsible for Instagram's privacy practices.
Social embeds can be recognized by the respective company logos next to a picture or post or other externally recognizable content. After activating the social embed, you will be able to see the Instagram content that we have included on our Website.
No Personal Data, such as your IP address, will be transmitted to Instagram before you click on the respective "View Content" button ("Activation Button").

Both, GEMELLii and Facebook, are each responsible for certain parts regarding the processing of your data when you use the Instagram Site. However, the main focus of data processing is on Facebook. In the following, we explain how this works in detail and what your rights are towards us and Facebook:
- Data processing by GEMELLii
The manner and extent to which personal data is collected when one visits an Instagram Site, depends heavily on the user's behaviour and may partly be influenced by the user, meaning by you.
1.1. Statistical evaluations
When you visit our Instagram Site and do not engage in other active uses, such as liking or sharing content, we do not receive any personally identifiable information from you.
However, we do use statistical analyses of the use of our Instagram Site, which are provided to us by Facebook via "Instagram Insights" in an anonymized form ("Analyses"). In particular, the evaluations include the following data:
• Number of "likes" of our posts
• Number of comments on our posts
• Number of people who have seen a post
• Number of times a post was shared
• Number of times a post was reported as spam
• Number of times it was clicked that the user no longer likes the page
These evaluations sent to us by Facebook are anonymous. We cannot associate the evaluations with your person. However, this does not necessarily mean that the data collection and data processing at Facebook itself is also anonymous. Please read the further information on data processing by Facebook at https://de-de.facebook.com/help/instagram/155833707900388 and below.
1.2. Processing of personal data
We only receive personal data from you when you actively click on something, for example, when you like, post, share, comment or otherwise actively conduct any other user’s action. We also receive your personal data when you use certain hashtags or when we share your Instagram posts.
Personal data that we then process is/are only the data that you publish on Instagram and that is visible for us and other users ("Action Data") – for example, your (user) name and the content published through your profile, if you have configured so in your Instagram privacy settings. We do not receive background usage data (such as your IP address or device number or information you have not made public) or other "hidden" data from you or Facebook.
Please do not provide us with any special categories of personal data through Instagram, including but not limited to information/data about/on your health, religious beliefs or sex life.
1.3. Purposes of the processing
We process the Action Data exclusively for the following purposes pursued by you and us on Instagram:
• Display on our Instagram Site and operation of our Instagram Site, as well as
• Reply to your private messages (direct messages) addressed to us and your public messages, replies or posts addressed to us on Instagram or our Instagram Site.
In particular, we do not create profiles of you or mix the Action Data with any other data we have about you - unless you specifically request us to do so.
1.4. Legal basis
We process the Action Data based on our legitimate interest in providing our users and subscribers on Instagram with relevant content and in enabling you to use our Instagram Site and its functionalities, (Art. 6 para. 1 lit. f General Data Protection Regulation (“GDPR”)). When replying to your messages, answers or posts, the fulfilment of your request is the legal basis of our data processing, (Art. 6 para. 1 lit. b GDPR).
In individual cases, we may need your consent to process your promotional data, for example if a post we post contains a picture of you. If so, we will explain further details of this data processing in connection with obtaining your consent.
1.5. Storage duration
We will process your Action Data for the purposes described above only for as long as necessary, which is generally as long as we operate our Instagram Site or as long as your active action on our Instagram Site is online or until we have replayed to your direct message in a definite manner. Beyond that, we only store the Action Data to fulfil any legal retention obligations.
1.6. Data recipients
In connection with the here described purposes, We may transfer your promotional information to external service providers, such as IT service providers. We have carefully selected these service providers and have concluded order processing agreements with them.
Insofar as this is necessary for the execution of the contract, we will in individual cases also pass on your campaign data to other responsible persons who process the personal data for their own purposes. Our contractual partners may use the data transmitted in this way exclusively for the purpose for which we have transmitted it. The transmission of your campaign data for these purposes is carried out for the fulfilment of the contract, (Art. 6 Para. 1 lit. b GDPR) or due to our legitimate interest in making our operations efficient, (Art. 6 Para. 1 lit. f GDPR).
1.6.3. Other recipients
Furthermore, we only transfer your Action Data to other recipients if and to the extent required or permitted by law, or to enforce legal claims or to investigate or prevent suspected or actual illegal activities. In these cases, we will inform you separately about the respective transfer if and to the extent required by law.
